| The Styler Terms and Conditions
INFORMATION FROM SUBSCRIBERS
All registration information provided by a subscriber to Copley Internet Systems must be accurate and complete. Subscribers must update and correct registration information as needed.
Copley Internet Systems may disclose subscriber information and information about subscriber's customers and site visitors as required by law or to enforce these terms and conditions.
SECURITY
Access to The Styler services is based on the subscriber's account username and password. Each subscriber must notify Copley Internet Systems promptly if the subscriber believes that the security of his or her account has been compromised.
Copley Internet Systems has taken reasonable steps to protect the security of online transactions. HOWEVER, COPLEY INTERNET SYSTEMS CANNOT AND DOES NOT WARRANT SUCH SECURITY AND WILL NOT BE LIABLE FOR ANY LOSSES OR DAMAGES RESULTING FROM ANY SECURITY BREACHES.
AGE
Every subscriber (or person acting on behalf of a subscriber) must be 17 years old or older.
REMOVAL OF SITES
Copley Internet Systems cannot and does not screen all content provided in subscriber sites and does not assume any obligation to monitor content. HOWEVER, SUBSCRIBERS AGREE THAT COPLEY INTERNET SYSTEMS MAY MONITOR SITES AND CONTENT PERIODICALLY, AND COPLEY INTERNET SYSTEMS RESERVES THE RIGHT AT ITS SOLE DISCRETION TO REMOVE ANY SITE, WITHOUT NOTICE AND WITH NO OBLIGATION TO REFUND FEES PAID, WHICH IN OUR JUDGMENT WE DETERMINE TO BE IN VIOLATION OF THESE POLICIES OR OTHERWISE UNLAWFUL OR HARMFUL.
BILLING
The fee for Copley Internet Systems includes a one-time setup charge and a monthly charge, billed monthly in advance. Subscribers will initially be billed the setup charge and the first month of service when they publish their sites. Billing is automatic to the subscriber's credit card every month thereafter, and subscribers agree to preauthorize Copley Internet Systems to charge our then-current fees to their credit cards. Subscribers will be notified if fees are going to be raised before their cards are charged. All fees are non-refundable and non-transferable. The sites of subscribers who cancel their credit-card accounts or whose credit cards expire without first providing other accounts for us to bill may be removed.
SITES REMOVED FOR VIOLATION OF THESE TERMS AND CONDITIONS WILL NOT RECEIVE REFUNDS.
CANCELING AN ACCOUNT
Subscribers may cancel their accounts directly online. Immediately upon termination, all subscriber information and content will be taken offline. The subscriber will not receive any additional bills and no additional fees will be charged to their credit cards. However, Copley Internet Systems will not provide pro-rated refunds.
CONTENT
Subscribers to Copley Internet Systems, can use their sites for business or non-business purposes. However, subscribers may not post, transmit, or market the following:
- Any material that is threatening, abusive, defamatory, obscene, discriminatory, or otherwise offensive or unlawful;
- Any material that violates the copyrights, trademarks, service marks, trade secrets, patents or other property rights of others;
- Any pornographic material or links to adult content;
- Any material that discloses private matters about any person without consent;
- Any material anonymously or under a false name.
MISUSE OF SYSTEM
Copley Internet Systems does not want to be associated with companies that send unsolicited commercial E-mail for marketing, known as "spamming." Copley Internet Systems sites may not be promoted in unsolicited E-mail.
Sites may not contain or transmit any file or software with a virus or other contaminating or destructive features.
No subscriber may in any manner, intentional or otherwise, interfere with the content of other sites or the system.
Sites may not use excess system resources or otherwise, in our judgment, use resources in a manner that damages our system.
RESPONSIBILITIES FOR SITES
Materials included on subscriber sites may include inaccuracies, errors, or out-and-out untruths. Copley Internet Systems has no liability or responsibility for any content, including the quality, accuracy, completeness, legality, or usefulness of any information, product, service or process promoted on subscriber sites. IN NO EVENT SHALL COPLEY INTERNET SYSTEMS BE LIABLE FOR ANY CLAIMS OR DAMAGES OF ANY KIND ARISING FROM THE CONTENTS OF SUBSCRIBER SITES.
References in subscribers sites to products, services, processes, hypertext links to third parties or other information by trade name, trademark, manufacturer, supplier or otherwise do not constitute or imply an endorsement or recommendation by Copley Internet Systems.
Product and service information are the sole responsibility of each individual site. Subscribers are solely responsible for compliance with laws governing the offering, sale, licensing, or other marketing and taxation of any products.
On occasion, Copley Internet Systems will undergo routine maintenance or experience unexpected technical problems. Copley Internet Systems will make a good-faith effort to do maintenance as quickly and conveniently as possible, and to respond to technical problems promptly. Copley Internet Systems may be required to access a subscriber's account from time to time to provide maintenance. Copley Internet Systems will not in any circumstances be responsible for problems, losses, or damages arising from loss of connectivity; errors in content due to application problems; loss of access to subscribers; or temporary or permanent loss of data.
The Copley Internet Systems server is backed up periodically. We will make reasonable efforts to restore data in the event of unforeseen disasters.
Network Solutions, and other domain name registrars, are independent companies providing optional domain name registration for Copley Internet Systems subscribers. Copley Internet Systems bears no responsibility for the services or billing of domain name registrars.
INDEMNITY
EACH SUBSCRIBER MUST INDEMNIFY COPLEY INTERNET SYSTEMS, INC. AND CAROLINA MADE, INC. AGAINST ALL CLAIMS MADE BY ANY THIRD PARTY, AND ANY RELATED DAMAGES AND EXPENSES (INCLUDING REASONABLE ATTORNEYS' FEES), ARISING OUT OF OR CONNECTED WITH THE SUBSCRIBER'S CONDUCT, THE SUBSCRIBER'S WEB SITE, THE GOODS OR SERVICE THE SUBSCRIBER OFFERS, OR ANY VIOLATION OF THESE TERMS AND CONDITIONS BY THE SUBSCRIBER.
LIMITATION OF LIABILITY
COPLEY INTERNET SYSTEMS, INC. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, RELATED TO THESE SERVICES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Copley Internet Systems, Inc. will not be liable to any subscriber for indirect, incidental, special or consequential damages, such as (but not limited to) loss of profits or business interruption, arising out of or connected to the use of, or inability to use, the services provided to any subscriber. The total liability of Copley Internet Systems, Inc. for any and all damages arising from or connected with these Terms and Conditions or the services provided to any subscriber shall not exceed the total fees paid by the subscriber to Copley Internet Systems during the 12-month period immediately preceding the initial occurrence of the event causing the damages.
Copley Internet Systems MAKES NO WARRANTIES, EXPRESS OR IMPLIED, RELATED TO THE AVAILABILITY OF PRODUCTS DEPICTED IN ITS CATALOG THAT MAY BE INCLUDED IN SUBSCRIBERS' SITES. The catalog is provided as a convenience to subscribers. Carolina Made, Inc. may add and delete items in its catalog without notice, and may make changes to its product offering that are not immediately reflected in the catalog it makes available to subscribers.
TRADEMARKS
The names and logos of Copley Internet Systems, Carolina Made, Inc., the The Styler, and manufacturers manufacturers of products displayed by this service are the trademarks and service marks of their respective owners, and may not be sold, reused, or altered in way without their owners written consent.
PROMOTIONAL ACTIVITIES
Copley Internet Systems may use subscriber information in aggregate and non-identifiable form for promotional purposes.
Copley Internet Systems may identify a subscriber and a subscriber's site as users of Copley Internet Systems's services in promotional materials.
SERVICE AND SUPPORT
Copley Internet Systems provides a Frequently Asked Questions page and customer support via the E-mail address info@copleyinternet.com. Copley Internet Systems will respond as quickly as practical to subscriber questions and complaints.
CHANGES IN THESE TERMS AND CONDITIONS
Copley Internet Systems reserves the right to change these Terms and Conditions from time to time. We will notify subscribers of all changes.
GOVERNING LAW
These Terms and Conditions are governed by North Carolina law. All litigation arising under or related to these Terms and Conditions or any site must be pursued in a North Carolina state court or a Federal court in North Carolina.
